GENERAL TERMS AND CONDITIONS OF SALE

1. Purpose
These General Terms and Conditions of Sale ("Terms of Sale") govern all sales of products made by DAY TWO to individual consumers on the website https://daytwo.gg.
They apply exclusively to orders placed directly on the daytwo.gg website.
These Terms of Sale are available at all times on the website and must be accepted by the customer before confirming their order.

DAY TWO is covered by the French VAT exemption scheme for small businesses (franchise en base de TVA).
VAT not applicable, art. 293 B of the French General Tax Code (CGI).
3. Products
DAY TWO sells physical products intended in particular for collectible card games.
At launch, the website offers one card sleeve product in a single colour.
Unless otherwise stated on the product page, each box is sold as containing 100 sleeves.
The essential characteristics of the product, including its colour, size, quantity and compatibility, are shown on the product page before ordering.
Product photographs and visuals are for illustration purposes. Minor variations in colour rendering may result in particular from the settings of the customer's screen or device.
The products offered for sale are available in stock. DAY TWO does not offer pre-orders at launch.
4. Prices
The selling price of the product at launch is €9.99 per box.
Prices are shown in euros.
As DAY TWO is covered by the French VAT exemption scheme for small businesses, no VAT is charged.
The applicable statement is:
"VAT not applicable, art. 293 B of the CGI".
Shipping costs are charged in addition when the order does not qualify for free shipping. Their amount is shown to the customer before the order is finally confirmed.
The applicable price is the one shown on the website when the order is confirmed.
5. Promotional offers
Any promotional codes, discounts and commercial offers are valid under the conditions stated when they are issued.
Unless otherwise stated, promotional offers cannot be combined.
DAY TWO may modify or end a promotional offer under the conditions stated when it was published, without affecting orders already confirmed.
6. Ordering
The customer selects the products they wish to order and adds them to their cart.
Before confirming their order, the customer can check and change the products, quantities, delivery address and other information entered.
The customer must read and accept these Terms of Sale before confirming the order.
Final confirmation of the order entails an obligation to pay.
Payment is due immediately when the order is confirmed.
After confirmation and payment, an order confirmation is sent to the customer by email.
This confirmation summarises in particular the products ordered, quantities, prices, any shipping costs and the delivery address.
The order becomes final once payment has been received and DAY TWO has confirmed the order.
7. Refusal or cancellation of an order
DAY TWO may exceptionally refuse or cancel an order, in particular in the following cases:
out of stock;
an obvious error in the price or characteristics of the product;
a payment problem;
reasonable suspicion of fraud or fraudulent use of a means of payment;
inability to fulfil the order for a reason beyond DAY TWO's control.
If DAY TWO cancels an order after payment, the amounts actually paid for that order are refunded in full to the customer, using the same means of payment as for the order, unless otherwise agreed.
This option does not limit the consumer's rights under the law.
8. Payment
Payment is made using the payment methods offered on the website at the time of ordering.
Available payment methods may include those offered by Shopify Payments, PayPal, Apple Pay, Google Pay, Shop Pay or any other payment method enabled on the website.
Payment is due in full at the time of ordering.
DAY TWO cannot be held liable for a malfunction attributable to the payment provider used, subject to its legal obligations.
9. Delivery
The applicable delivery conditions and times are set out in DAY TWO's Shipping policy.
Orders are shipped from France.
Deliveries are available to metropolitan France, Belgium, Luxembourg, the Netherlands, Germany, Italy and Spain (excluding the Canary Islands, Ceuta and Melilla).
Delivery is made to the customer's home or to a pickup point, depending on the options available when ordering.
Shipping costs are those shown to the customer before the order is confirmed.
Pickup point delivery is free from:
€28 for metropolitan France, Belgium, Luxembourg and the Netherlands;
€45 for Germany, Italy and Spain.
Home delivery is free from €45 for metropolitan France.
Orders are prepared within an estimated 2 working days.
The estimated delivery times after shipping are 2 to 5 working days for metropolitan France and 3 to 7 working days for the other countries served.
The maximum contractual delivery time is 14 days, unless otherwise agreed with the customer or where circumstances legally justify a different time.
Orders may be shipped from Monday to Saturday.
10. Transfer of ownership and risk
Ownership of the products is transferred once the price has been paid in full.
In accordance with the rules applicable to consumer sales, the risk of loss of or damage to the products passes to the customer when the customer, or a third party designated by them other than the carrier proposed by DAY TWO, takes physical possession of the products.
11. Right of withdrawal
In accordance with the French Consumer Code, the consumer has 14 days to exercise their right of withdrawal, without having to give a reason.
For sales of goods, this period starts from the day the product is received by the customer, or by a third party designated by them for this purpose other than the carrier.

The customer may also use the withdrawal form available on the website, where one is provided.
The customer must communicate their decision to withdraw before the 14-day period expires.
After communicating their decision, the customer has a further 14 days to return the products.

Unless the product is defective or not as described, the direct cost of returning it is borne by the customer.
The customer must return the product in a condition that allows its nature, characteristics and proper functioning to be checked. Where the product has packaging or seals needed to protect it, the customer is invited to keep them intact.
The customer may however be held liable for any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product.
12. Refund in the event of withdrawal
If the right of withdrawal is validly exercised, DAY TWO refunds the amounts paid by the customer, including the standard shipping costs applicable to the order.
The refund is made under the conditions provided for by law and no later than 14 days after the date on which DAY TWO was informed of the customer's decision to withdraw.
For a sale of goods, DAY TWO may withhold the refund until it has received the product back or until the customer has provided proof of having sent it, whichever is earlier.
The refund is made using the same means of payment as for the original transaction, unless the customer expressly agrees to another means of payment.
Once the return conditions have been checked, DAY TWO undertakes to issue the refund within an internal target of 7 working days, without this internal target reducing the consumer's legal rights.
Additional costs resulting from the customer choosing a delivery method more expensive than the standard delivery method are not refunded.
13. Legal guarantees
Products sold by DAY TWO benefit from the applicable legal guarantees, in particular:
the legal guarantee of conformity;
the legal guarantee against hidden defects.
13.1 Legal guarantee of conformity
In accordance with articles L. 217-3 et seq. of the French Consumer Code, the seller is liable for any lack of conformity existing at the time of delivery that becomes apparent within two years of delivery.
In the event of a lack of conformity, the consumer may ask for the goods to be brought into conformity by repair or replacement, under the conditions provided for by law. Failing that, they may obtain a price reduction or the termination of the contract under the legal conditions.

13.2 Legal guarantee against hidden defects
In accordance with articles 1641 et seq. of the French Civil Code, DAY TWO is bound by the guarantee against hidden defects in the product sold that make it unfit for its intended use, or that reduce that use so much that the customer would not have bought it, or would have paid a lower price, had they known of them.
Under the conditions provided for by law, the customer may choose between returning the product and getting the price refunded, or keeping the product and getting part of the price refunded.

14. No additional commercial guarantee
DAY TWO does not grant any commercial guarantee beyond the applicable legal guarantees, unless expressly stated otherwise for a particular offer.
15. Liability
DAY TWO is responsible for the proper performance of the obligations arising from the sales contract under the conditions provided for by law.
DAY TWO cannot be held liable for indirect damage or losses that do not result from a breach of its legal or contractual obligations.
Nothing in these Terms of Sale may limit or exclude any liability that cannot legally be limited or excluded, in particular regarding legal guarantees, product safety or consumer rights.
16. Force majeure
DAY TWO cannot be held liable for a delay or failure to perform resulting from an event of force majeure within the meaning of French law and case law.
Where possible, DAY TWO will inform the customer of such an event and take reasonable measures to limit its consequences.
The consumer's rights under the law remain applicable.
17. Intellectual property
The content of the daytwo.gg website, including texts, photographs, illustrations, logos, trademarks, graphics, designs and other content, is protected by applicable intellectual property law.
Any unauthorised reproduction, representation, adaptation or use of this content is prohibited.

Personal data collected in connection with orders is processed in accordance with DAY TWO's Privacy policy.
